Lillian’s incest allegation case flops
By Charles Musonda
LILLIAN Chileshe has lost a defamation of character case in which she sued her friend and namesake Lillian Monde for allegedly accusing her of committing incest with her own biological brother and her brother-in-law, who is her older sister’s husband.
Chileshe, 25, of Makeni KX sued Monde, 27, of Makeni Villa over the incest allegations which were laid bare during celebrations of President Hakainde Hichilema’s second term victory last month.
“We were at a bar drinking beer to celebrate the President’s victory when my sister walked and I tried to hug her but she pushed me away,” Chileshe said.
“When she was walking back home, I tried to follow her but she refused to walk with me and she told me to never step on the grounds of her house because according to her, I sleep with my brother Jack and her husband.”
She said she later learned that it was Monde who had told her sister only identified as amake Davy.
Chileshe said even Jack’s wife was aware of the incest allegation.
She said she only confided in Monde that she was afraid of sleeping at her sister’s house anymore because each time she spent a night there when visiting her brother-in-law always attempted to force himself on her.
She told her drinking mates during a drinking spree that one day she knee-butted him when he tried to force himself on her as his wife was in alcohol-induced deep sleep.
In her response, Monde said it was Chileshe herself who had brought up the incest story.
She said Chileshe used to be her friend but that they were no longer in good books.
Monde admitted sharing the incest story with Chileshe’s sister because the Chileshe herself had started it.
Asked by by magistrate Ng’andu Mukuka, who sat with Justice Esther Mulomba, what type of alcohol they imbibed, Monde said it was Black Label was their favorite lager.
Justice Mukuka wondered why such young women were destroying themselves in such a fashion. When called as Monde’s witnesses, Beatrice Banda, 30, who was also drinking with both Chileshe and Monde during Hichilema’s victory celebration, said Chileshe had told them that her brother-in-law always attempted to make love to her when her older sister was in her habitual heavy intoxication.
In her judgment, Justice Mulomba told Chileshe that the mistake she made was to confide events in her family in others instead of being secretive.
“You took issues to your friends. Just go and sleep if you are drunk,” Mulomba said.
She also advised Monde to keep secrets , saying what she had done was wrong because other people’s marriages were at stake and that she had created enmity in the family.
Mulomba dismissed the case on grounds that there was no defamation of character.
