Divorce leaves loving Mavis in hot tears

MAVIS Chishala was left in tears after she was divorced by Justin Musakanya against her wish. Chishala told Matero local court magistrate Moses Lubuwa that although Musakanya, 36, beats her and had the habit of going away from home for many months for illegal mining, she is still her husband and loves him.
The two, who are both Jehovah’s Witnesses of Chisamba, got married in 2018 and have three children.
“We had peace at first now that peace is gone because my husband doesn’t talk, he just beats me and he is not honest because at one time he attempted to sell our house without my knowledge.
“He likes making love to me when I am fast asleep and I only wake up to find the evidence.
One day I was shocked, hurt and I cried when he was masturbating in my presence around 15:00 hours as if I deny him his conjugal rights,” Chishala, 28, said.
She said although Musakanya was complaining against her bad alcohol drinking habits, he is the one who made a mistake by teaching her how to imbibe beer.
She said she did not understand when she found that Musakanya had put a black chicken feather on her underwear.
In cross examination Musakanya did not have questions for Chishala.
In his s statement, he said Chishala drinks alcohol too much and returns home in the wee hours. He said whenever she is gripped with jealous, she goes for a fierce drink-up and when she comes back home around 01:00 hours, and sometimes 02:00 hours, she starts insulting him and his family.
He said whenever she finds a female client in his shop she becomes suspicious and that therefore he cannot continue living with such a woman for fear of killing each other.
He said church elders sat them and tried to reconcile them based on scriptures read in the meeting but to no avail. In his judgment, Matero local court magistrate Moses Lubuwa said there is need for people to get married with maturity.
He advised Musakanya to engage in proper communication on bedroom issues and that if his wife is not responding accordingly, unleashing gender based violence on her is not a solution.
He said marriage is good when there is peace and divorce is bad hence the need for couples to have love, forgiveness, and humility for each other.
He granted divorce and ordered Musakanya to compensate Chishala with K10,000 beginning with K1,000 and thereafter K500 monthly, saying marriage is a contract and she needs to benefit.
