Cop testifies against 2 homosexual accused

A POLICE officer of Lusaka has told a Lusaka magistrates’ court how he arrested and charged two male youths after they were allegedly found having sex in a toilet at the Zambia Army’s Burma Barracks,
Constable Emmanuel Sapaulu from Kabwata Police Station testified that he charged the suspects, Brighton Banda and Darius Musukwa, with unnatural offences.
Sapaulu said this was after the two students were found having sex in a toilet by a man who went to meet someone at the bar inside Burma Barracks mess.
“After I got the findings of the medical examination from the hospital were consistent with the allegations, I decided to detain them for the offence of unnatural offence,” Sapaulu to the court.
It is alleged that the two students on February 24, 2024 had carnal knowledge against the order of nature, which Banda and Musukwa, who are in their 20s, have pleaded not guilty to.
On Tuesday, Sapaulu narrated that on February 24, 2024, while on duty, he received a report from Quarters Fumpa, who was accompanied by Emmanuel Lungu, a Zambia Army officer, that two youths had been caught having sex in a toilet in the barracks.
He said they took the suspects to the police for allegedly having carnal knowledge against the order of nature.
“They were found having carnal knowledge against the order of nature in the toilets at Burma Barracks around 16:30 hours,” Sapaulu said.
He said acting on the report, he interviewed the two suspects and took them to the University Teaching Hospital (UTH) for medical examination, whose results were consistent with the allegations against them.
“I decided to charge them with the said offence after the report from the UTH. Your Honour, I arrested them and that is why I am before the court today,” Sapaulu said.
