NAPSA drags AFSL to court over non-remittance of contributions

By Esther Chisola

THE National Pension Scheme Authority (NAPSA) has sued the Associated Fire Services Limited in the Lusaka High Court demanding payment of K3,964,446.15 being money in respect of penalty arrears as a result of late remittance of contributions.

The authority also wants interest, damages, and costs.

According to a statement of claim filed in the Lusaka High Court, NAPSA submitted that the Associated Fire Services Limited, as the defendant in the matter, is mandated to remit NAPSA contributions for workers at the end of each month.

NAPSA, who is the plaintiff, submitted that if the aforementioned payment is not made within the stated time limit, such a payment would attract a 20 percent cumulative penalty for each month, and after December 6, 2022, such a payment would attract a 10 percent cumulative penalty.

“The plaintiff will at trial show that the defendant has been remitting monthly contributions, albeit some contributions were made late and as a result the defendant has accumulated debt in penalty arrears in the sum of K3,964,446.15,” stated NAPSA.

NAPSA submitted that despite several reminders and written correspondence, the defendant has failed to comply with its mandatory requirement to comply with the law.

NAPSA submitted that Associated Fire Services Limited has neglected and failed to pay K3,964,446.15.
