Simfukwe’s mother demands K21m compensation

THE mother of slain Enock Kasengele Simfukwe, Grace Nachilima has dragged incarcerated farmer Maria Zaloumis and her Nigerian boyfriend Nathaniel Barthram to court demanding over K21 million in damages for the death of her son.
The murder case involving renowned Zambian farmer Maria also known as Zed Farmer and Nathaniel has taken a new twist with the family of the deceased Enock Simfukwe, suing the suspects demanding K21, 908,201 million compensation.
Maria, Nathaniel and three others are jointly charged with the murder of 22 year old Kasengele. They are currently remanded at Mukobeko Maximum Correctional Facility in Kabwe awaiting trial.
However, court documents filed in the Lusaka High Court and seen by The Mast, Nachilima alleges that Kasengele was unlawfully detained on August 16, 2025, beaten and tortured while tied with ropes.
Kasengele who is seen in a widely shared video can be heard pleading for mercy, which did not restrain his assailants from the cruel act of inflicting physical abuse until he tragically died the following day.
A postmortem report dated August 20, 2025 confirmed that Kasengele succumbed to a brain contusion, which the family lawyers said was directly caused by the violent acts of the accused.
Lawyer representing Nachilima and family, Patrick Chulu Legal Practitioners said the video had caused profound mental anguish to the mother of the deceased, who has reportedly sought professional therapy to cope with the trauma.
“Our client has suffered profound mental anguish and emotional distress, including tremors, as a direct result of viewing the video of her son’s torture,” they stated.
The victim’s family is seeking relief and claims for damages under several categories, which include K5 million for negligence, causing death, K10 million for dependency under the Fatal Accidents Act, K3 million for loss of expectation of life, K250,000 for funeral expenses, and K3,658,201 for mental anguish and trauma, bringing the total claim to K21,908,201.
Nachilima argued that the actions of Maria and others violated Kasengele’s constitutional rights to life and liberty.
She further claims that she has endured severe mental anguish and trauma, including tremors, after watching the video of her son’s torture.
Nachilima has since sought professional therapy to cope with the emotional distress.
